Ex miner drags AngloGold to Con Court

[miningmx.com] — A disabled former mine worker will head to the Constitutional Court on August 17 to further pursue a lawsuit for damages against his previous employer AngloGold Ashanti.

Thembekile Manyaki claims he became crippled after working underground the gold producer’s mines where he was exposed to harmful dust and gas.

AngloGold ruled that his condition warranted compensation and paid him R16 320.

Manyaki later sued for further damages in the High Court in Johannesburg but was ruled against due to existing compensation law.

He then took the matter to the Supreme Court of Appeals where his case was, again, dismissed.

The outcome of the case will hinge on the differences between compensation law
and mining law.
