State, ICT to appeal Sishen judgment

[miningmx] — THE Department of Mineral Resources (DMR) and Imperial Crown Trading 289 (ICT) have lodged applications for leave to appeal against the judgment of the Supreme Court of Appeal (SCA) in the case over Kumba Iron Ore’s mining right at Sishen mine.

The Supreme Court last week dismissed an earlier appeal by the DMR and ICT against a North Gauteng High Court judgment, delivered in December 2011, which held that Kumba was granted an exclusive right to mine iron ore at Sishen in 2008 and set aside a prospecting right granted to ICT.

“Shareholders are advised that both ICT and the DMR have lodged applications for leave to appeal to the Constitutional Court against the decision of the SCA,’ Kumba said in a statement on Tuesday. “Shareholders will be kept informed of any further material developments.’
